fyi Motion filed to dismiss child porn charges The attorney for a former Utah State University student accused of downloading child pornography on the Internet filed a motion Monday arguing that charges filed against his client are unconstitutional and should be dismissed. The motion filed by Peter Goodall, the attorney for 24-year-old Tyler John Zesiger, states that because the Federal Child Pornography Act was declared unconstitutional by the U.S. Supreme Court in 2002, a "materially similar" 1999 Utah law should also be ruled unconstitutional and 100 second-degree felony charges of sex exploitation of a minor filed against Zesiger should be dismissed.
