Several years ago, as a list we decided not to publicly offer "IN PRINT" ORB mp3s out of basic respect for the band. This was agreed upon by the list and to some extent the Orb itself by way of Smiley's connections. I'm sure not every list member was aware of this, so now you all know. It's really not that bad, since a large majority of the ORB catalog is out of print anyway. I think we all can appreciate the fact that you are being generous in letting the list members download the tracks you have collected. However, though you do have the right to put any Mp3s on your site, THIS LIST is not the forum to offer "IN PRINT" ORB material for public use. I'd like to here Smiley's comments when he gets a chance. Yeah...I got it. "Asking" for it, even obliquely, is uncool. Being willing to host it is uncool. Indeed, the mere fact that he is apparently "archiving" them publicly is uncool...it encourages others not to patronize BadOrb, since they know they can just download them at their leisure.
I think most of the people that use his ftp server, are people on this list, and similar lists. I think that the vast majority of these people (us) are going to buy from badorb even if badorb had free mp3's of the tracks, and if we wouldn't, having the free downloads couldn't further discourage a purchase. On the other hand, I think mr stringer should buy the badorbs himself... Like bi11ie said, it was a mistake to share the "personal" mp3 files, perhaps this is the same thing that rmstringer is doing too. It's his computer, he no doubt plays the mp3s from the location that the ftp server sees, so why shouldn't he have the music that he wants to hear there? Of course again, he could go through and make all the "in-print" stuff invisible and/or otherwise block it from the FTP, but if other people can't be arsed to do this, why should he? either way you look at it, I won't be downloading any badorb stuff from his ftp, but I *will* download other stuff. He uploads stuff to my server as well, and I send stuff to him. This was when we were setting up the OAA, rm's FTP server is not the OAA, and never pretended to be. Many of the other FTP sites that have popped up since have went along with this (out of habit perhaps?) <snip>

Actually, he does *NOT* have the right to put almost any of those FTP's and other files on his site. I don't believe that any of us have distribution rights or own the copyright to the majority of the files that are hosted by the various sites. While the copyright law can be interpreted that we can have a copy of recordings that we own, we cannot distribute them, or allow them to be distributed.

And why not? If people are going to download that stuff, they'll get it from scour, limewire, soulseek, irc, etc... I don't ever recall rm saying "hey folks, I have the new badorb tracks on my server, rush over and download them so you don't have to pay!" He said that he wanted bob9 (recently) and although I think he should buy his own copy, this is not my perogative. I won't supply him with an illegal copy. I say shame on the person who does, not shame on rm for having a file on his computer. again, who cares what he has on his computer, when he gets the collection of dolphin pr0n, that's when I'll start downloading... :)
