Ebay should have some rules to protect you in that case. You have a right to a refund if you are sold an item that isn't legitimate even if the seller is unaware. I think their rules used an example of a piece of jewelry with a fake stone. I ended up having to use it when someone tried to sell me a rare toy that was incomplete and UV damaged. They tried to say that it wasn't their fault because they didn't know that wasn't original condition of the toy. I imagine you could use it for a record too. That is if they haven't changed the rules around.
